from Your Honour - is an ill-chosen one. The high position of the Chief Justice, occupied as he is with matters outside the conduct of administration, naturally separate him from the affairs of the executive Government and this isolation can alone clothe him with the qualifications requisite in a referee or adviser. In my predecessor's time I find that this attitude had become changed to one of correspondence of a controversial nature with the Chief Justice on subjects raised by himself, and with extreme regret I am forced to admit that the same condi❤ -tions apply to the brief period during which I have myself been here. This condition, and the one I previously described äre mutually destructive. In the question of the Court Vacation referred to by Your Honour in this paragraph, the matter was certainly referred to the Chamber of Commerce with a view to asking their advice as to how the proposals were viewed by the business interests of the Community.

I understand from a private note from Your Honour that the request contained in your final paragraph has been courteously withdrawn in deference to an expression of opinion by myself to the effect that while I cordially agree that verbal discussion is most useful in order to clear the ground and define the issues, it is to be deprecated when once the matter has become the subject of official correspondence, and the arguments have been fully set out; with possible ultimate reference to the Secretary of State. Conversation in such circumstances is apt to lead to misapprehensions, and takes up much time which I am well aware Your Honour has not to spare, and which I too find it difficult to arrange.
